Brazil Privacy Notice

Effective date: November 2, 2020

This Brazil Privacy Notice is provided as a supplement to our User Privacy Notice and includes information about your rights under the Lei Geral de Proteção de Dados Pessoais (“LGPD”). This Brazil Privacy notice does not apply to the personal data we collect from employees or job applicants.

1.  Collection of personal data

We collect the following categories of personal data about our users:

  • Identifiers, such as name, alias, postal address, unique personal identifier, online identifier, internet protocol (IP) address, email address, account name, tax ID number, driver’s license number, passport number or other similar identifiers.
  • Customer Records, such as physical characteristics or description, telephone number, bank account number, credit card number, debit card number, or any other financial information.
  • Personal Characteristics or Traits, such as demographic data.
  • Customer Account Details / Commercial Information, such as records of personal property, products or services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies.
  • Internet Usage Information, such as browsing history, search history, and information regarding a consumer’s interaction with our website, application or advertisement.
  • Geolocation Data, such as physical location or movements and travel patterns.
  • Sensory Data, such as audio recordings of customer service calls.
  • Inferences derived from personal data, such as information about your interests or purchase preferences.

Please note that we may not collect each of these categories about every consumer. To understand more about what personal data we collect, please review Section 4 (What personal data we collect and process) of our User Privacy Notice.

2.  Information about the shared use of personal data

We share personal data with service providers and other vendors. The following Table lists the categories of personal data shared and the categories of recipients who receive this personal data. Please note that not every one of the following categories may apply to your personal data.

3.  LGPD Rights

The LGPD provides new rights to Brazilian data subjects. These include rights to: confirmation of the existence of processing; access to data; correction; anonymization, blocking, or deletion of unnecessary data; portability; deletion of personal data processed with consent; information about public and private entities with which data is shared; information about the possibility of denying consent and the consequences of denial; and revocation of consent. This section provides more information about those rights and how a Brazilian data subject can exercise these rights under the LGPD. For eBay to fulfill your request, you must provide sufficient information for us to reasonably verify that you are the data subject from whom we collected the personal data. The information you send for us to verify your identity will be used for this purpose only. If we are unable to verify your identity or if we suspect fraudulent activity, we may decline to comply with your request.

We will make commercially reasonable efforts to identify your personal data that we collect, process, store, disclose and otherwise use and to respond to your requests. In addition, we will not honor your requests to the extent that doing so would infringe upon our or any other person or party’s rights or conflict with applicable law. If we deny your request, we will explain the reasons in our response.

3.1  Right to access

  • Brazilian data subjects have a right to access and obtain a copy of their personal data.
  • If you are a registered eBay user with an account in good standing, you can request a copy of the data we hold about you at any time through your eBay account.
  • If your eBay account has been suspended or if you do not have a registered eBay account, you may submit your request through our webform.

3.2  Right to deletion

  • Subject to certain exceptions, Brazilian data subjects have the right to request deletion of their personal data.
  • If you are a registered eBay user with an account in good standing, you can submit a deletion request at any time through your eBay account. Click here to submit your request (you will need to scroll to the bottom of the page and click “Close my account and delete my data”). Your account will be closed as part of fulfilling your deletion request.
  • If your eBay account has been suspended or if you do not have a registered eBay account, you may submit your request through our webform.

3.3  Other rights

  • You can exercise your other privacy rights, including your right to confirmation of the existence of processing, data portability, and revocation of consent by submitting a request through our webform.

We reserve the right to change this Brazil Privacy Notice from time to time. Changes shall become effective on the date they are posted.

China Privacy Notice

This China Privacy Notice is provided as a supplement to our User Privacy Notice and includes information about your rights under the Personal Information Protection Law of the People’s Republic of China (“China”) ("PIPL").

China Privacy Notice

1.  Personal information processor (“PIP”)

For China data subjects, the “controller” referred to in our User Privacy Notice means PIP under the PIPL. You may refer to Section 2 (Controller) and Section 3 (Data protection officer and contact) of our User Privacy Notice for names and contact information of the PIPs processing your personal data (which depend on how you use our Services).

2.  Collection of personal data

Under PIPL, "personal data" is all kinds of information, whether recorded in electronic or another format, that relates to an identified or identifiable natural person, excluding anonymized information; "sensitive personal data" refers to personal data that, if leaked or if used illegally, is likely to cause harm to a natural person's personal dignity or endanger his or her personal safety or the safety of his or her property.

We collect and process personal data, including sensitive personal data only for specified, explicit and reasonable purposes and to the extent directly relevant to the purposes of processing. We will process your personal data (including sensitive personal data) in a way that has the least impact on your personal rights and interests (for example, grant access to personal data to necessary personnel only, use encryption technologies during transmission and storage of sensitive personal data when necessary).

The personal data collected and processed by us that might constitute sensitive personal data is underlined in the following paragraphs. We will process sensitive personal data only if strict protection measures are put in place and there is sufficient necessity to justify the processing. It is necessary for us to process your sensitive personal data in order to perform the specific Services you request from us and for other specific purposes described in this China Privacy Notice.

  • When you set up your eBay account with us, to enter into a contract with you, we may collect from you your name, telephone/mobile number, email address, your user ID. After you have successfully registered an account, we may continuously collect updated personal data from you during the course of your use of such account for the purpose of enabling such account use for you.
  • When you bid, buy or make an offer on an item on our website or application, to provide you with our Services as you requested, we will collect from you, as the case may be, your name, user ID, shipping address, email address, telephone/mobile number, payment information (such as form of payment or payment method), invoice information and the information concerning your orders / purchases.
  • When you request delivery of purchased items, to facilitate the provision of shipping services to you as requested, we will collect shipping, telephone/mobile number and other information you provide, as well as information required for customs clearance (such as identification number) and relevant shipping information (such as shipment numbers and tracking information).
  • When you visit our websites or applications, we may collect certain information automatically from your device (including by using cookies and similar technologies). Please review Section 4.2 (Personal data we collect automatically when you use our Services or create an eBay account) and Section 4.3 (Personal data we collect in connection with the use of cookies and similar technologies) of our User Privacy Notice regarding what information we may automatically collect from you. Specifically, to provide location-based services to you, we may collect your general location data (such as IP address) and the precise location data of your mobile device. For most mobile devices, you can manage or disable the use of location services for all applications in the settings menu of your mobile device.
  • When you request for payment services from us as a seller, to provide our payment services in accordance with the Payments Terms of Use, we will collect from you certain identification data (such as identification number or date of birth) and other information (such as bank account number or credit card information).
  • When you participate in inquiries, customer service calls, or if you contact us for any other reason regarding our Services, to provide general customer support including resolving problems with your eBay account, and other services within the scope of customer service, we will collect your email address or telephone/mobile number from you. With your consent, to monitor, analyze and improve our Services, the customer service calls will be recorded.

By using our Services and/or providing your sensitive personal data to us, you will be deemed as having accepted and fully agreed to be bound by, and you consent to our processing of your sensitive personal data in accordance with the terms and conditions set out in the User Privacy Notice and this China Privacy Notice. If you do not want us to process your sensitive personal data, please do not use related Services which we are unable to provide without processing relevant sensitive personal data, as we illustrated in the User Privacy Notice and this China Privacy Notice.

3.  Legal basis for data processing

Pursuant to PIPL, we may process personal data if one of the following options applies:

  • Relevant data subject has given prior consent to processing of his/her/its personal data for one or more specific purposes;
  • Processing of personal data is necessary to conclude or perform a contract to which the data subject is party;
  • Processing is necessary for compliance with any statutory duties or legal obligations;
  • Processing is necessary in order to, in an emergency, to protect the lives, health or property of natural persons;
  • The personal data has been made public by the data subject concerned or has otherwise been lawfully made public, the processing is done pursuant to the PIPL and the extent of the processing is reasonable;
  • Processing is done in other circumstances provided for in applicable laws or administrative regulations.

By using our Services and/or providing your personal data to us, you will be deemed as having accepted and fully agreed to be bound by, and you consent to our processing of your personal data in accordance with the terms and conditions set out in the User Privacy Notice and this China Privacy Notice. We will not, however, process your personal data in a way prohibited by or not compliant with the PIPL.

4.  Sharing of personal data

For the purpose of providing you with our Services, we will share your personal data with eBay Inc. corporate family members, service providers and other vendors, as more specifically set out as follows:

  • eBay Inc. corporate family members
  • Advertising partners (with whom your sensitive personal data will not be shared)
  • Other eBay users
  • Service providers, including logistics/shipping service providers, payment service providers, financial institutions
  • Credit agencies (when required by law)
  • Participants in the eBay VeRO program

You understand and agree that we shall have the right to change our service providers and vendors at our sole discretion due to business development need and reasons such as changes in service and content providers. To the extent required by applicable law, we will, before sharing your personal data with such recipient, notify you of the name and contact details of the recipients, the purposes and means of processing and provision of your personal data, and the types of personal data to be provided and shared, and obtain your consent to the sharing of your personal data.

In any case, we will only share and transfer your personal data for specific and definite purposes pursuant to the principles of lawfulness, fairness, necessity and good faith, and only share and transfer the personal data to the extent necessary for the specific purposes you are informed of. If we share your personal data with the foregoing recipients, we may use encryption, anonymization and other means as necessary and appropriate to ensure your personal data security. Before sharing or transferring your personal data, we will follow and adopt the applicable process and requirements required by the applicable law in respect of transfer of your personal data.

The foregoing data recipients will use the personal data to the extent necessary for the specific purposes you are informed of and store the personal data for the minimum length of time required to fulfil the purposes, or as prescribed by the applicable law.

5.  Rights under PIPL

The PIPL provides certain rights to China data subjects. These include rights of: knowing about and deciding on the processing of your personal data; access to and making copy of your personal data; correction and supplement of inaccurate or incomplete personal data; portability; withdrawal of consent with future effect; deletion; and requesting explanations of the rules governing the processing of your personal data. This section provides more information about those rights and how a China data subject can exercise these rights under the PIPL. 5.2  Right to deletion

  • Subject to the following conditions, China data subjects have the right to request deletion of their personal data:
    • the processing purpose has been achieved or is unachievable or the personal data is no longer necessary to achieve the processing purpose;
    • we had ceased to offer the products or services or the retention period has expired;
    • the data subject has withdrawn his or her consent;
    • we have processed personal data in violation of a law or administrative regulation or in breach of our User Agreement, the User Privacy Notice and this China Privacy Notice; or
    • other circumstances provided for in laws or administrative regulations.
  • If the retention period provided for in laws or administrative regulations has not yet expired or the personal data would technically be difficult to delete, we will cease the processing except for storage and the taking of necessary security protection measures.
  • If you are a registered eBay user with an account , you can submit a deletion request at any time through your eBay account. UK Credit Reference Notice

Effective date: April 8, 2024

This UK Credit Reference Notice is provided as a supplement to our User Privacy Notice and includes information relating to our use of credit reference agencies in the UK.

Where you apply to use our marketplace or payments services, we may check your details with a fraud prevention agency/agencies and credit reference agencies. If you give false or inaccurate information and we identify fraud, this will be recorded and may be shared by those agencies with other organisations and us, so that we and those other organisations, including law enforcement agencies and debt collection agencies, may access, use and search these records to:

(a) help make decisions about credit and credit related services, for you and members of your household;

(b) help make decisions on motor, household, credit, life and other insurance proposals and insurance claims, for you and members of your household;

(c) trace debtors, recover debt, prevent fraud, and to manage your accounts or insurance policies;

(d) prevent fraud and money laundering, for example, when:

  • Checking details on applications for credit and credit related or other facilities;
  • Managing credit and credit related accounts or facilities;
  • Checking details on proposals and claims for all types of insurance; and
  • Checking details of job applicants and employees.

Any credit reference agency whose records we search will keep a record of any search, and lenders may use it to assess applications they receive from you in the future.

You acknowledge that credit reference agencies link together the records of you and anyone that you have advised is a financial associate (e.g. someone with whom you have a joint credit account) including previous and subsequent names of parties to the account. Links between financial associates will remain on your, and their, credit reference files until such time as you or your partner successfully files for a disassociation with the credit reference agencies. When assessing the affordability of your repayments, we may take into account information about your financial associates in your credit reference.
